How Startup Founders Can Qualify for Advanced Manufacturing Tax Credits

Learn which factory credit fits, what sales count, and how to file for payment before profitability.

Founders qualify by making eligible components in the United States and selling them to unrelated buyers. They can also qualify by building a qualifying clean-energy or semiconductor facility and claiming an investment credit. Advanced manufacturing tax credits are federal incentives for domestic production. Section 45X rewards output sold each year, while Sections 48C and 48D reward factory investment.

Which credit fits your factory?

Use Section 45X if you will manufacture eligible solar, wind, inverter, battery-component or critical-mineral output in the United States. The Internal Revenue Service describes that eligible output in its Form 7207 instructions. Use Section 48C for a qualifying advanced-energy factory investment.

Use Section 48D if the facility's primary purpose is making finished semiconductors or semiconductor-manufacturing equipment. You cannot stack support on the same output. Components made at a facility that claimed the Section 48C credit cannot also earn 45X, so choose a production-credit or investment-credit strategy early.

What counts as a qualifying 45X sale?

You must show substantial transformation into a distinct eligible component. You must also show an arm's-length sale, meaning an independent market-price deal, in the same trade or business.

Stockpiled inventory and internal transfers do not qualify. Check each batch before you claim:.

  • Make the product in the United States
  • Transform inputs into a distinct eligible component
  • Sell to an unrelated person at arm's length
  • Report the sale on Form 7207

What do 48C and 48D facilities need to prove?

Section 48C offers 6%, rising to 30% only with prevailing-wage and apprenticeship compliance. It is capped at $10 billion, with at least $4 billion reserved for energy-community tracts, and requires DOE concept-paper review plus IRS allocation before claiming on Form 3468.

48D also limits founders with ties to China, Russia, Iran or North Korea. It bars foreign entities of concern and major semiconductor-capacity expansions in covered nations, with a 10-year recapture risk if rules are broken.

How can pre-profit startups get cash?

Pre-profit startups can still monetize credits through elective pay or transfer. Elective pay means the IRS pays the credit value in cash, while transfer means selling the credit to another taxpayer. You must complete IRS pre-filing registration to obtain a registration number.

Then file Forms 3468 and 3800 by the return due date. Timing also affects value under 45X. The statute phases the credit to 75% in 2030, 50% in 2031 and 25% in 2032, and generally expires after 2032, as shown in the text of Section 45X. Plan sales and registration so qualifying sales fall in higher-value years.
